What Is Probate?

Simply put, probate describes the process of applying to the registry to handle a person’s affairs after they’ve died. An application for a formal grant goes to the courts, and if approved, it ensures that the executor or administrator has authority to handle debts and collect and divide any remaining assets.

 

Applying for Probate: Understanding The Two Types Of Application

Grant of probate

If you locate a will after a person has passed away and it names you as the executor, you will need to apply for a grant of probate. This legal document details that you, as the executor, have the authority and responsibility to handle the administration of the deceased’s estate.

Grant of letters of administration

When no will has been written, as the next of kin or close relative of the deceased, you should apply for grant of letters of administration. This legal document, if granted, confirms that you will have authority as an administrator to organise the person’s estate.

 

How Long Does Probate Take To Complete?

Ideally, when you apply for a grant of probate or grant of letters of administration, it can take 3-5 weeks to hear back from the registry. However, these timings are very dependent on the accuracy of the application. Although no formal guarantees can be made, the registry may be able to give an indication when you make your application.
