What Does Dealing With An Estate Mean?

When a loved one passes away, their estate (personal affairs) need to be managed. If you’ve recently been bereaved, we appreciate that the last thing on your mind may be coordinating this process.

Depending on how organised your loved one was before they passed away, we know that dealing with an estate can be a time-consuming process.

The First Steps When Dealing With An Estate Include:

  • Establishing if your loved one had a will (you may find it in their personal documents, or it may have been stored at a lawyer’s office, or a financial institution)
  • If no will is in place, you’ll have to decide who will act as an executor in organising the affairs
  • If a predetermined executor decides not to be involved, an administrator will need to be appointed

What Comes Next?

You’ll need to organise the person’s affairs:

  • Money (wealth) owed to the deceased needs to be collected
  • Debts owed by the deceased must be paid off
  • Outstanding tax payments need to be arranged
  • Leftover wealth (inheritance) should be divided between the relevant parties (either stated in a will, or failing that, to lawful beneficiaries)

During this sensitive time, it can be hard to think about distributing assets and belongings that are special to you in some way. It’s useful to seek legal advice, not only for your peace of mind, but to ensure that all affairs are processed lawfully.
